1. Agreement to these terms
Somporko™ is a relationship-first technology platform. Somporko AI™ is our configurable SaaS platform for building, deploying, and managing AI voice assistants. Somporko Diary™ is our private AI voice journal product and is currently available through a beta program.
These Terms and Conditions govern your access to and use of Somporko websites, early-access forms, demos, products, communications, and related services. By accessing or using the services, you agree to these terms and acknowledge our Privacy Policy.
2. Product status and availability
Somporko products are early-stage and may include beta, preview, pilot, or demonstration features. Features, availability, integrations, supported use cases, pricing, performance, and timelines may change. Submitting an early-access request does not guarantee access, availability, pricing, support, or a future commercial relationship.
References to future ideas or product directions are informational and do not guarantee that a specific feature, product, timeline, or service will be offered.
3. Somporko Diary beta eligibility and access
The current Somporko Diary beta is intended only for adults age 18 and older. The initial beta may be invite-only, limited to English, limited to U.S. phone numbers, and limited to one verified mobile number per account.
You are responsible for providing accurate account information, protecting access to your email, mobile device, sessions, and phone PIN, and promptly notifying us if you believe your account has been accessed without authorization. You may not share an account or PIN in a way that compromises another person’s privacy.
4. Somporko Diary service description
Somporko Diary™ may process voice reflections, create transcripts, generate diary entries, support editing and search, and provide features such as Memory Lane, Continue Reflection, Ask Somporko, Insights, export, deletion, and optional backups.
Generated diary entries are an AI-assisted interpretation of your reflection. You are responsible for reviewing and correcting entries before relying on them as an accurate record.
5. Your content and ownership
You retain your rights in the reflections, transcripts, diary entries, edits, questions, feedback, files, and other content you provide to the services, subject to any rights belonging to other people.
You grant Somporko a limited, non-exclusive license to host, process, transcribe, transform, retrieve, display, transmit, back up, and otherwise use your content only as reasonably necessary to provide, secure, maintain, and improve the services, comply with law, and enforce these terms.
Private Somporko Diary™ content will not be used to train general-purpose models for unrelated customers unless you affirmatively agree through a separate, clear choice.
6. Diary controls, exports, backups, and deletion
Somporko Diary™ is designed to let you review, edit, search, export, and delete diary entries and transcripts, and request deletion of your account. Some information may remain for limited periods for backup cycles, security, fraud prevention, billing, dispute resolution, or legal compliance.
If you connect Google Drive or another third-party backup service, you authorize the data transfers needed for that feature. You are responsible for access to the connected account and for deleting copies stored outside Somporko.
7. No therapy, medical advice, or emergency service
Somporko Diary is a journaling and personal reflection product. It is not therapy, counseling, diagnosis, treatment, medical advice, or crisis care. Somporko AI is not a medical provider and does not provide medical, legal, financial, insurance, or other professional advice.
Do not rely on Somporko products for emergencies or situations requiring immediate human response. Contact local emergency services or a qualified professional when appropriate.
8. AI limitations and human review
AI systems can misunderstand speech, produce inaccurate or incomplete responses, assign an incorrect theme or mood, retrieve an unrelated entry, fail to complete a task, or be unavailable. Users and business customers are responsible for reviewing important outputs and maintaining appropriate human oversight.
9. Business customer responsibilities
Businesses using Somporko AI are responsible for the assistants they configure or deploy, including prompts, scripts, workflows, integrations, data inputs, call notices, recording and transcription notices, customer communications, consent flows, escalation rules, and compliance for their use case.
Implementation and partner services
Customers may configure Somporko AI directly or obtain implementation, integration, migration, training, or optimization services from Somporko or a third-party implementation partner. Third-party partner services may be governed by a separate agreement between the customer and that partner. Unless Somporko expressly agrees otherwise in writing, independent partners are responsible for their own services, representations, fees, and performance.
Businesses must test their workflows and provide a human path for urgent, sensitive, complex, or regulated situations when appropriate.
10. Calls, recordings, transcripts, and consent
Somporko products may use automated systems to answer or place calls, understand speech, generate responses, create transcripts, and complete requested workflows. Depending on the configuration, calls may create transcripts, summaries, logs, and recordings.
Businesses and users are responsible for providing notices and obtaining permissions required for call recording, transcription, messaging, or other communications in their jurisdiction.
11. Acceptable use
You may not use the services to:
- violate law, infringe rights, or access another person’s private information without authorization;
- send deceptive, abusive, harassing, discriminatory, fraudulent, or unauthorized communications;
- impersonate another person or misrepresent your identity or authority;
- upload malicious code, interfere with systems, bypass access controls, or attempt unauthorized access;
- reverse engineer, scrape, copy, or misuse the services except as permitted by law or written authorization;
- use Somporko Diary™ to store content you do not have the right to provide.
12. SMS Terms
Somporko AI may send SMS messages when a caller requests or agrees to receive text messages during an interaction, or when a user requests account verification or another transactional message. Messages may include appointment confirmations, reminders, inquiry follow-up, demo follow-up, account verification, service updates, and related communications.
The website Early Access forms do not automatically enroll anyone in recurring marketing SMS messages. Somporko does not send unsolicited SMS marketing campaigns through these forms.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out of applicable messages and HELP for help. Consent to receive SMS is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.
Mobile phone numbers, mobile opt-in information, and SMS consent will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
13. Third-party services
Somporko may use or integrate with third-party services for hosting, email, telephony, SMS, transcription, AI processing, authentication, scheduling, storage, backup, analytics, payments, and support. Third-party services have their own terms, policies, limitations, and availability.
14. Fees and commercial terms
If paid services are offered, fees, billing, cancellation, service levels, support, and other commercial terms may be provided in a separate agreement, order form, checkout flow, or product-specific terms.
15. Somporko intellectual property
Somporko™, Somporko AI™, Somporko Diary™, the Somporko logo, website content, designs, software, workflows, product concepts, and related materials are owned by Somporko or its licensors and are protected by applicable intellectual property laws.
These terms do not grant you ownership of Somporko technology or branding. You may not copy, modify, distribute, sell, license, or use them except as permitted by us in writing or by applicable law.
16. Feedback
If you provide ideas, suggestions, ratings, comments, or feedback, you allow us to use them to evaluate and improve Somporko products without restriction or compensation, unless we agree otherwise in writing. This feedback license does not give us ownership of your private diary entries.
17. Confidentiality and sensitive information
Do not submit confidential, regulated, or sensitive information unless necessary for your requested service and you are authorized to share it. Business customers are responsible for deciding what data may be entered into their workflows.
18. Suspension and termination
We may suspend, restrict, or terminate access if necessary to protect users, systems, or legal rights, respond to misuse, enforce these terms, or end a beta program. You may stop using the services at any time and may request account deletion where available.
19. Changes to services and terms
We may update, suspend, discontinue, or change the services. We may update these terms by posting a revised version with a new “Last updated” date and providing additional notice when appropriate.
20. Disclaimers
The websites and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, and reliability.
21. Limitation of liability
To the maximum extent permitted by law, Somporko and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunities, or goodwill arising from or related to the services.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
22. Indemnification
If you use Somporko on behalf of a business or organization, the business or organization agrees to defend and indemnify Somporko from claims arising from its prompts, workflows, communications, data, legal compliance, or use of the services, to the extent permitted by law.
23. Governing law
Unless otherwise required by law or agreed in writing, these terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
